WASHINGTON: Tanya Chutkan, a US District Judge, ruled that spouses of H-1B visa holders can work in the US tech sector. This is a big relief for foreign workers in the US tech sector. This decision was made after Judge Chutkan threw out a lawsuit filed by Save Jobs USA. The lawsuit tried to remove a rule from the Obama administration that gave spouses of some H-1B visa holders permission to work.
Apple, Amazon, Google, and Microsoft, all well-known tech companies, fought against the lawsuit. The US has given almost 100,000 work permits to the spouses of H-1B workers, many of whom are Indian.

Judge Chutkan said that Congress had given the US Government the power to let H-4 spouses work as a condition for staying in the US. He disagreed with Save Jobs USA’s claim that Congress had not given the Department of Homeland Security the power to let foreign nationals, like H-4 visa holders, work while they are in the US.
The judge wrote that Congress’s explicit and implicit approval of this practice and years of practice by the executive branch run right into the Immigration and Nationality Act.

Ajay Bhutoria, a community leader and advocate for immigrant rights, praised the decision, saying that it would help families who are having trouble financially in a big way.
The H1B visa program lets skilled people from other countries come to the U.S. to work for companies here. Still, until recently, their spouses were not allowed to work, which put a huge financial strain on their families. Bhutoria hopes this decision will make the immigration system more fair and kind. On the other hand, Save Jobs USA plans to appeal the court’s decision.
